Advice on child custody agreement and conflict of interest on his lawyers part?

My soon to be ex husband is using one of his friends to represent him in our child custody case and she is representing him for free. This same person has given me legal advice in the past regarding this and I am now searching for a lawyer and having to shell out 5000 or more. Is this legal? I am in the military and had to sign a temporary custody agreement to him because I cannot provide a family care plan and I'm also afraid that might affect me although the agreement states that " the acquiescence of physical custody on a temporary basis shall not be used to benefit nor exclude the rights of either party in any future proceedings.". I want to eventually file for primary physical custody. Do you think this will have an effect? Again I am currently clearing the army and I also have military medical records from social services stating my husband is categorized as abusive.
